FCC Wins at D.C. Circuit on 5.9 GHz

The D.C. Circuit Friday upheld the FCC’s authority in its decision to repurpose part of the 5.9 GHz band to meet spectrum demands in an opinion issued Friday. The decision came after the FCC proposed keeping the upper 30 MHz of the band for use by intelligent transportation systems while repurposing the lower 45 MHz for unlicensed use.
